These Terms of Service (“Terms”) govern your access to and use of the website orangecountyapostilleandnotary.com and the services offered by Orange County Apostille & Notary (“we,” “us,” “our”). By using our website or services, you agree to these Terms. If you do not agree, please do not use the website or services.
1) Services We Provide
- Notary Public Services: in-office and, when available, mobile notary services in accordance with California law.
- Apostille/Authentication Facilitation: document handling, submission, and courier support to state/federal agencies or consulates. We are a facilitator, not a government agency.
- General Support: scheduling, document routing, and status updates as available.
2) Important Disclaimers
- Not Legal Advice / Not Attorneys: We are not attorneys and do not provide legal advice. Nothing on our site or in our communications should be considered legal advice. For legal questions, consult a licensed attorney.
- No Attorney–Client Relationship: Your use of our site or services does not create an attorney–client relationship.
- Document Responsibility: You are solely responsible for the accuracy, completeness, and legality of the documents you present. We may refuse service if documents appear incomplete, fraudulent, or outside the scope permitted by law.
- Processing Times Not Guaranteed: Apostille and consular processing times are controlled by government agencies and may change without notice. We cannot guarantee turnaround times or approvals.
3) Identification & Signer Requirements (Notary)
- Valid, acceptable government-issued photo ID is required for notarization (e.g., driver’s license, passport) per California Notary law.
- Signers must appear in person, be competent, and willing. We reserve the right to decline service if requirements are not met.
- We follow California maximum fee schedules and applicable notarial procedures.
4) Appointments, Walk-Ins & Mobile Service
- Walk-ins: Welcome during normal business hours; availability may vary.
- Appointments: We try to honor appointment times; delays may occur.
- Mobile Notary: If offered, mobile service includes additional travel/after-hours fees and may be subject to availability, parking, and access constraints.
5) Fees, Payments & Refunds
- Pricing: Posted rates apply to standard in-office notarial acts. Additional services (mobile, travel, waiting time, translations, shipping/courier, government fees) are separate.
- Quotes: Estimates are provided for convenience and may change based on document count, destination, shipping speed, or agency updates.
- Payment: Due at time of service unless otherwise stated. We may accept cash, card, or other methods as posted.
- Refunds: Notary fees are for time and service rendered and are generally non-refundable once performed. For apostille facilitation, third-party/government fees and shipping are non-refundable once submitted/used. If you cancel before submission or shipment, we will make reasonable efforts to stop processing, but cannot guarantee refunds from third parties.
- Chargebacks: Filing a chargeback for services properly rendered may be contested with documentation.
6) Shipping, Handling & Risk of Loss
- When shipping is requested, we use reputable carriers. Risk of loss passes to you upon carrier acceptance. We are not responsible for carrier delays, loss, or damage.
- Please review shipping addresses carefully; incorrect addresses may cause delays or loss.
7) User Conduct & Site Use
- You agree not to misuse the website, attempt to bypass security, or submit unlawful content.
- Content on the site (text, logos, design) is our property or used with permission; you may not reproduce it without consent.
8) Privacy
Your use of the website is also governed by our Privacy Policy, which explains how we collect, use, and share information, including cookies, analytics, and advertising (e.g., Google Ads).
9) Warranties & Liability
- As-Is: The website and services are provided “as is” and “as available” without warranties of any kind, express or implied.
- No Guarantee: We do not warrant that services will meet your requirements or be uninterrupted, timely, or error-free.
- Limitation of Liability: To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.
10) Indemnification
You agree to indemnify and hold harmless Orange County Apostille & Notary and our owners, employees, and contractors from any claims, damages, or expenses arising out of your use of the website or services, your documents, or your violation of these Terms or applicable law.
11) Third-Party Services & Links
We may link to or use services from third parties (e.g., payment processors, shipping carriers, government agencies). We are not responsible for their content, policies, or actions. Your use of third-party services is governed by their terms.
12) Changes to the Terms
We may update these Terms from time to time. Changes are effective when posted on this page with a new Effective Date. Your continued use after changes means you accept the revised Terms.
13) Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any disputes shall be brought in the state or federal courts located in Orange County, California, and you consent to their jurisdiction and venue.
